Last Will and Testament
A Last Will and Testament (or Will for short) is a legally binding document that directs what is to be done with your property after your death. In order for the Will to be legally-binding, it must be signed in the presence of two witnesses (who are not beneficiaries of the will). Cynthia will draw up the Will and provide the witnesses. She will also keep the original copy of the Will in her fire-proof safe to ensure it is not misplaced or damaged.
Powers of Attorney
There are two types of Powers of Attorney:
Power of Attorney for Property - This is the financial Power of Attorney. Should you be incapacitated, your Power of Attorney for Property will be able to access your bank account and pay your bills on your behalf. If you do not appoint someone, the government will act as you Power of Attorney for Property.
Power of Attorney for Personal Care - This is the medical Power of Attorney. Should you be incapacitated, your Power of Attorney for Personal Care will be able to make any medical decisions for you. Nursing and retirement homes usually require this Power of Attorney. If you do not appoint someone, your next of kin can act as your Power of Attorney for Personal Care.
